SHELL ADVANTAGE REWARDS SHELL HELIX AFFORDABLE PREMIUM RANGE RM25 OFF Q1 CONSUMER PROMOTION 2021 – TERMS AND CONDITIONS

    General

  1. The Shell Helix Package (the “Package”) is organized by Shell Malaysia Trading Sdn Bhd (Co. No. 196501000279), if the redemption of a Voucher is made in Peninsular Malaysia or Shell Timur Sdn Bhd (Co.No. 198401000783), if the redemption of a Voucher is made in East Malaysia (individually, “Shell”, for the purpose of the terms and conditions of the Package only).
  2. These terms and conditions shall apply to:
    1. any SHARE Participant being any Shell Helix Branded Workshops [and any Independent Workshops] which agree to the Package (“Participating Workshop”); and
    2. any End Customer (“Consumer”) who purchases a Voucher.
  3. The Shell Advantage Rewards Program General Terms and Conditions, the SHARE Program Privacy Policy and the SHARE Program Benefits Terms and Conditions shall continue to apply in addition to these terms of the Package where relevant. Any terms defined therein shall apply to these terms. Further terms may be stated on a Voucher, which shall also apply in addition to these terms. In the event of any conflict, the terms of the Package shall prevail.

    4. Vouchers

  4. Shell shall make available for purchase by a Consumer a voucher which may be redeemed by a Consumer for the provision of vehicle maintenance services and specific Shell lubricants products in conjunction with those services by a Participating Workshop (the “Voucher”).
  5. The specific services to be provided by a Participating Workshop, together with any specific Shell Lubricants products to be provided in conjunction with those services, shall be as advertised on the Voucher or the relevant website or page at which a Voucher is purchased.
  6. All Vouchers shall:
    1. Only be valid for specific car models listed in the product description or as stated at the relevant website or page at which a Voucher is purchased;
    2. Only be valid for 30 days from the date of purchase;
    3. Only be redeemable at Participating Workshops;
    4. Be non-refundable and cannot be redeemed for cash;
    5. Not be valid with any other on-going promotion by Shell or a Participating Workshop;
    6. Be subject to other conditions which may be displayed at the relevant website or page where it is offered.
    7. The service will be provided by 3rd party independent workshop operation (not by Shell).

    7. Booking and Redemption

  7. A Consumer who purchases a Voucher shall proceed to perform the necessary steps as outlined in the “Redemption Instructions” below.
  8. When notified, whether through the SHARE application or otherwise, a Participating Workshop shall confirm or reject a booking request from a Consumer depending on its availability, but shall at all times provide the required services to a Consumer within a reasonable time frame and not cause a Consumer to have his or her Voucher invalidated.
  9. Upon successful redemption and booking (in accordance with the Redemption Instructions below), the Participating Workshop shall provide those services (and the use or sale of the specific Shell lubricants products in conjunction with those services) to a Consumer at the appointed time, date and location.
  10. In the event a Consumer requires services other than as advertised, the Participating Workshop may be required to charge for these other services at their discretion.

    11. Liability and Indemnity

  11. By agreeing to the Package or by purchasing a Voucher, Shell, Consumers and Participating Workshops acknowledge that Shell merely offers the Voucher pursuant to the Package, and the actual provision of any services or products in conjunction with those services pursuant to a Voucher, and any obligation, liability and responsibility thereto, shall be as between the Consumer and the Participating Workshop. As such:
    1. a Consumer shall hold harmless and indemnify Shell from any and all loss or damage incurred or suffered arising out of or caused by the provision of services and products in conjunction with those services by a Participating Workshop to a Consumer;
    2. a Participating Workshop:
      1. shall provide the services and the Shell lubricants products (if any) in conjunction with those services to a Consumer who successfully redeems a voucher;
      2. warrants that all services supplied to a Consumer shall be as described on the Voucher, shall be free from any defect or deficiency and shall be performed diligently, efficiently and carefully in a good and professional manner;
      3. holds harmless and indemnifies Shell from any and all loss or damage incurred or suffered by any Consumer arising out of or caused by the provision of services by a Participating Workshop to a Consumer.

    Changes to Terms

  12. Shell reserves the right to cancel, terminate or suspend the Package with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by Shell of the Package shall not entitle any party to any claim or compensation against Shell for any and all losses or damage suffered or incurred by any party as a direct or indirect result of the act of cancellation, termination or suspension.
  13. Shell reserves the right at its absolute discretion to amend, delete or add to any of the Package terms and conditions from time to time without prior notice, including the list of Participating Workshops.

    14. Other

  14. All Consumers and Participating Workshops shall be responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to the Package.
  15. Shell shall reimburse the relevant Participating Workshop within a reasonable time frame for and after the provision of services at prices already agreed, as may be varied from time to time subject to mutual agreement.
  16. By purchasing a Voucher or by participating in the Package, all Consumers and Participating Workshops expressly hereby consent to and allow :
    1. Shell, its Affiliates and its agencies to process and disclose to any third party, all Personal Data of the Consumer for any and all purposes in relation to the Package and any and all other activity relating to or arising from the course of business or businesses of Shell and its Affiliates;
    2. Shell to collect, use, disclose and share amongst its Affiliates and their respective service providers, a Consumer’s or Participating Workshops’ Personal Data, including the photographs or audio-video or other recordings for publicity and/or use in advertisements across all media, in its original or edited format, and whether to promote the SHARE Program, the Package or otherwise without further notification, remuneration or compensation; and
    3. Shell, its Affiliates, its appointed service providers and Participating Workshops to process a Consumer’s Personal Data provided pursuant to the Package and in accordance to the SHARE Program Privacy Policy which forms an integral part of these terms and conditions.

    17. Redemption Instructions

    How to redeem:

    1. After purchase of Shell Helix Package, you will receive a voucher code via push notification in your Shopee App. Please follow the steps below to redeem: -
      • Step 1: Visit https://shell.com.my/shareebooking
      • Step 2: Enter and verify your mobile number via OTP
      • Step 3: Enter your Name, Vehicle Registration Plate Number, Email Address and select your service
      • Step 4: Tick Consent box (allow Workshop to contact you), SHARE Terms and Conditions and Privacy Statement boxes and click “Next”
      • Step 5: Choose your servicing workshop on the list provided
      • Step 6: Choose your preferred service date and time
      • Step 7: Enter voucher code under “Promotion Code” section
      • Step 8: Submit your booking by clicking “Confirm Booking”
        (You will receive a booking ID which can be used to track your booking status via https://shell.com.my/shareetracking) or to access “My Booking” page to view/edit or cancel confirmed bookings
    2. Visit the selected workshop and workshop staff to inspect vehicles prior redemption of voucher.
      • Note: Booking is not confirmed until your selected workshop accepts your booking.
      • When workshop accepts or rejects your booking, a notification will be sent to you via SMS and Email.
    3. Any additional replacement of original oil filter, parts, additional lubricants, fluid, bots, nuts, filters, gasket or more required, are subject to charges and tax.
    4. Present your confirmation on the booking sent to you via SMS or email (after workshop accepts your booking) and the voucher code to workshop to complete the redemption during the agreed time and date by both purchaser and workshop.
