Shell Advantage Rewards General Terms and Conditions

  1. The Shell Advantage Rewards and Shell Consumer Lubricants Program (“PROGRAM”) GENERAL TERMS AND CONDITIONS
    1. The Shell Advantage Rewards and Shell Consumer Lubricants Program (collectively referred to as “PROGRAM”) organized by PT. Shell Indonesia (referred to as “Shell”) is made available to you subject to the PROGRAM General Terms and Conditions as stated below.
    2. Without limitation, registering and signing up for the PROGRAM with the relevant PROGRAM Profile, accessing the PROGRAM Website and/or downloading/using the PROGRAM Mobile Application shall signify your acceptance of the PROGRAM General Terms and Conditions, the PROGRAM Privacy Policy and the PROGRAM Benefits Terms and Conditions (collectively referred to as “PROGRAM Terms and Conditions”).
    3. Participation in the PROGRAM is at your absolute option and risk, and in no event shall Shell be liable for any loss or damages including without limitations, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise, in connection with the PROGRAM, even if Shell has been advised of the possibility of such damages in advance, and all such damages are expressly excluded.
    4. The PROGRAM is open only to the following categories of persons in Indonesia who shall be collectively referred to as eligible PROGRAM Participants:
      1. all Authorized Shell Lubricants Distributors;
      2. all Sales Representatives of Authorized Shell Lubricants Distributors;
      3. all Shell Branded Workshops;
      4. all Independent Workshops;
      5. all Owners of Shell Branded Workshops and Independent Workshops;
      6. all Mechanics lawfully employed at Shell Branded Workshops and Independent Workshops;
      7. all End Customers who buy and use selected genuine Shell Lubricants products by Shell for oil changes at Shell Branded Workshops or Independent Workshops; and
      8. all End Customers who buy selected genuine Shell Lubricants products by Shell from Shell Petrol Station Retailers.
    5. PROGRAM Participants who are corporations, partnerships, enterprises and sole proprietors must be lawfully incorporated in accordance with Indonesian laws.
    6. PROGRAM Participants who are individuals must not be less than 21 years old at the time of registration and sign-up for the PROGRAM.
    7. The following categories of persons shall not be accepted as eligible PROGRAM Participants:

      service providers engaged by Shell and its Affiliates (including but not limited to advertising agencies, promotion agencies, printing companies and event management agencies); and their permanent and/or contract employees (“Employees”) and the Employees’ immediate family members i.e. spouses, children, parents, brothers and sisters (“Immediate Family Members”).

    8. To participate in the PROGRAM and enjoy the PROGRAM Benefits under the PROGRAM Benefits Terms and Conditions, eligible PROGRAM Participants must:
      1. successfully register themselves under the relevant PROGRAM Profile via the PROGRAM Website or PROGRAM Mobile Application using an Indonesian mobile phone number; and
      2. fulfil the relevant stated criteria to enjoy the corresponding relevant stated PROGRAM Benefit as stated in the PROGRAM Benefits Terms and Conditions.
    9. By registering and signing up for the PROGRAM with the relevant PROGRAM Profile, accessing the PROGRAM Website and/or downloading/using the PROGRAM Mobile Application, the PROGRAM Participants expressly agree and consent to:
      1. participate in the PROGRAM and be bound by the PROGRAM Terms and Conditions including all Shell’s decisions in relation to the PROGRAM;
      2. allow Shell, its Affiliates and its agencies to process and disclose to any third party, all Personal Data of the PROGRAM Participants provided by the PROGRAM Participants for the PROGRAM for any and all purposes in relation to the PROGRAM and any and all other activity relating to or arising from the course of business or businesses of Shell and its Affiliates;
      3. represent and warrant the accuracy and contemporary of the data provided to Shell;
      4. allow Shell to collect, use, disclose and share amongst themselves and their respective service providers, the PROGRAM Participants’ Personal Data, including the photographs or audio-video or other recordings of the PROGRAM Participants for publicity and/or use in advertisements across all media, in its original or edited format, and whether to promote the PROGRAM or otherwise without further notification, remuneration or compensation;
      5. authorize Shell to process the PROGRAM Participants’ Personal Data provided pursuant to the PROGRAM in accordance to the PROGRAM Privacy Policy which forms an integral part of the PROGRAM General Terms and Conditions; and
      6. follow and comply with Indonesia tax law and regulations for PROGRAM Benefits Terms and Conditions.
    10. All Shell’s decision on all matters including but not limited to the eligibility of the PROGRAM Participants, the mechanics for the PROGRAM Benefits or in the event of any dispute shall be final and binding and no correspondence or appeals shall be entertained.
    11. Shell reserves the right to cancel, terminate or suspend the PROGRAM with or without any prior notice. For the avoidance of doubt, cancellation, termination or suspension by Shell of the PROGRAM shall not entitle any party to any claim or compensation against Shell for any and all losses or damage suffered or incurred by any party as a direct or indirect result of the act of cancellation, termination or suspension.
    12. All PROGRAM Participants shall be personally responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to the PROGRAM.
    13. Shell reserves the right at its absolute discretion to amend, delete or add to any of the PROGRAM Terms and Conditions from time to time without prior notice.
    14. The PROGRAM Terms and Conditions, as the same may be amended from time to time, shall prevail over any provisions or representations contained in any other promotional material advertising the PROGRAM.

    16. In the event where there is any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the English and Bahasa Indonesia versions of the PROGRAM Terms and Conditions, the Bahasa Indonesia version of the PROGRAM Terms and Conditions shall prevail.

    SHELL ADVANTAGE REWARDS PROGRAM (“SHARE PROGRAM”) BENEFITS TERMS AND CONDITIONS

    The SHARE Benefits under the SHARE Program Benefits Terms and Conditions are available to be enjoyed by SHARE Outlets Participants who successfully registered via SHARE Mobile Application as SHARE Members with completion of all mandatory registration fields. SHELL may require SHARE Outlets Participants to update and/or to provide additional information as a condition of continued use of the SHARE Benefits service. Any communication related to the SHARE PROGRAM will be made electronically by (a) sending electronic mail to the email address provided during registration, or (b) sending SMS to the mobile phone number provided.

    Only SHARE Members who received the SHARE Registration Confirmation via SMS text will be entitled to enjoy the SHARE Benefits.

    A. Qualifying Products under the SHARE Program

    1. 1. The Qualifying Products under the SHARE Program are:
      1. Shell Helix;
      2. Shell Rimula;
      3. Shell Advance;
      4. Shell Spirax; and
      5. Shell Gadus.
    2. Sales of Qualifying Products (as the case may be) must be accurately submitted by the SHARE Members to the SHARE Platform (SHARE Mobile Application) with completion of Product Code and Vehicle Registration Number & Mileage (where relevant).
    3. Order of Qualifying Products (as the case may be) must be accurately submitted by the SHARE Members to the SHARE Platform (SHARE Mobile Application) and processed until order completion by Authorized Shell Lubricants Distributors in the area.

    B. SHARE Benefits for SHARE Outlets Participants

    The following SHARE Benefits are available to be enjoyed by SHARE Outlets Participants of Qualifying Products subject to fulfilment of stated terms and conditions:

    1. SHARE PROGRAM : Register Product Code upon Shell Product Sales
      1.1. SHARE Outlets Participants shall enjoy a Shell Coins-based or direct gift Rewards Programs customized in accordance with their SHARE Profile upon sales of Shell Qualifying Product’s code submission in SHARE Mobile Application.
      1.2. The Rewards Programs is subject to change from time to time at Shell’s absolute discretion.
      1.3. Total Shell Coins issued or redeemed under the Rewards Program shall be capped at the maximum Shell Coins that can be earned from actual purchased of Qualifying Products from Authorized Shell Lubricants Distributors in the area.
    2. SHARE PROGRAM : Order Online Seasonal Promotion
      2.1. SHARE Outlets Participants shall enjoy a seasonal Shell Coins-based rewards or direct rewards from order online seasonal promotion customized in accordance with their SHARE Profile upon ordering Qualifying Product from Authorized Shell Lubricants Distributors via SHARE Mobile Application.
      2.2. The order online promotion is seasonal and is subject to change from time to time at Shell’s absolute discretion.
      2.3. Reward on the order online promotion will be given after the order submitted via SHARE Mobile Application has been processed by Sales Representatives of Authorized Shell Lubricants Distributors and completed by Authorized Shell Lubricants Distributors
    3. SHARE PROGRAM : Loyalty Promotion
      3.1. SHARE Outlets Participants will be enrolled to Loyalty Promotion selected package by Sales Representatives of Authorized Shell Lubricants Distributors in accordance with their SHARE Profile
      3.2. In the program, SHARE Outlets Participants should place order via SHARE Mobile Application with a committed volume of Qualifying Products in a certain period of time based on criteria in each package. All orders via SHARE Mobile Application will be counted as Loyalty Promotion achievement or progress if the orders have been processed by Sales Representatives of Authorized Shell Lubricants Distributors and completed by Authorized Shell Lubricants Distributors in the area within the criteria of Loyalty Promotion.
      3.3. SHARE Outlets Participants shall enjoy a Shell Coins-based rewards or direct rewards from the Loyalty Promotion upon completion of loyalty promotion package criteria.
      3.4. The Loyalty Promotion is subject to change from time to time at Shell’s absolute discretion.
    4. SHARE PROGRAM : Seasonal Promotion
      SHARE Members shall be entitled to enjoy other Shell Seasonal Promotions as notified to the SHARE Members via SMS text or in-app message notification, subject to the Terms and Conditions of the Seasonal Promotions.

    C. Terms and Conditions Applicable to all SHARE Benefits:

    1. The following terms and conditions apply to all SHARE Benefit Items:
      1. The SHARE Benefit Item is provided on an “As Is” basis while stocks last.
      2. The SHARE Benefit Item do not include any accessories or items that are shown in the promotional materials, as they are for illustrative purposes only.
      3. In the event of unavailability of the SHARE Benefit Item, Shell reserves the right to substitute the SHARE Benefit Item with any other gift of similar value at any time without prior notice.
      4. The SHARE Benefit Item is not exchangeable for cash, credit or kind.
      5. Shell will not be held liable for any mishaps, injuries or accidents that may occur in the redemption or use of the SHARE Benefit Item.
      6. To the fullest extent permitted by law, there are no, and Shell expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of the SHARE Benefit Item.
    2. Shell reserves the right at its absolute discretion to amend, delete or add to any of the SHARE Program Benefits Terms and Conditions from time to time without prior notice.
    3. These Terms and Conditions, as the same may be amended from time to time, shall prevail over any provisions or representations contained in any other promotional material advertising the SHARE Program.
